General terms and conditions

By using the www.intovent.nl website, you agree to be bound by the following terms and conditions and agree that these terms and conditions will form part of any agreement you enter into with Intovent B.V.


General Sales Conditions

  1. Prices

    1. Prices on our website are subject to typographical errors and/or obvious mistakes. No liability is accepted for the consequences of price changes.

    2. All prices are in Euros and include VAT.

  2. Delivery

    1. Our delivery time is usually 2 working days, unless a product is temporarily out of stock (in which case we will inform you).

    2. We supply more products than are shown on our website. You can always contact us to find out if we can deliver certain products and at what price.

  3. Returns and cancellations

    1. When buying remotely (internet orders), you have the right to a 90-day cooling-off period. This does not apply to products that are specially made for you.

    2. The product can only be returned if you exercise your right of withdrawal. In this case, the product must be returned to the trader with all accessories supplied and, if reasonably possible, in its original condition and packaging.

    3. Before an order can be returned, a notification must be made. This can be done without giving a reason. By law, you have up to 14 days from receipt of the order to do this. Intovent gives you 90 days.

    4. After this notification you have another 14 days to return the order, Intovent will pay the shipping costs for the return if it is not a pallet return. If it is a pallet return, the customer is responsible for the cost. Intovent will only pay the shipping costs if the customer uses the return label provided by Intovent. It is therefore advisable to use the return label provided by Intovent.

    5. In the case of a pallet return, the customer will be charged at the rate paid at the time.

    6. Cancellations must be made in writing. This can be done by e-mail. When cancelling, always quote your name, your order number and the total amount paid.

    7. Cancellation is free of charge. Items that have already been dispatched cannot be cancelled.

    8. Already paid amounts will be refunded within 14 days after receipt of the returned order to the same account from which the payment was made. 
  4. Warranty

    1. Intovent warrants that the goods will function in accordance with their specification for a period of twelve months from the date of delivery, provided that they have not been used. Intovent does not give any further guarantees. The warranty applies only to defects that were not reasonably apparent at the time of delivery.

    2. In the case of justified warranty claims:

      (i) Intovent undertakes to repair or replace the defective goods at its own expense, always at Intovent's discretion.

      (ii) The warranty is valid from the date of delivery of the goods until the end of the agreed period, provided that the buyer has at all times fulfilled all his obligations under the agreement with Intovent, and on the understanding that the warranty is void if the buyer or a third party makes any changes to the delivered goods or carries out any work on them (including maintenance) without the prior written consent of Intovent.

      (iii) The warranty is not valid in the event of:

      • careless or incompetent use by the purchaser.
      • failure to follow Intovent's instructions or directions for use.
      • defects caused by normal wear and tear and accidents or calamities such as fire, water damage, earthquakes, etc.
      • the applicability of any government regulation concerning the nature or quality of the goods or the working methods used.
      • goods, working methods and constructions, insofar as applied on the instruction of or on behalf of the buyer, as well as of goods supplied by or on behalf of the buyer.
    3. The warranty is at all times limited to repair or replacement and nothing more.

    4. The buyer must in all cases give Intovent a reasonable opportunity to remedy the defect or perform the processing or delivery, failing of which the buyer's claims shall lapse.

  5. Services

    1. Intovent shall perform the contract to the best of its knowledge and ability and in accordance with the requirements of good workmanship. Intovent reserves the right to have the previously agreed work reassessed on site by a professional Intovent technician.
    2. The same terms and conditions apply to a service/maintenance subscription as to a separate service request. Troubleshooting after a malfunction is not covered by a maintenance subscription.

    3. The service/maintenance subscription starts after Intovent has carried out an initial service and the device has been accepted for the service/maintenance subscription. If the device is accepted, we will immediately carry out the maintenance as part of the subscription.

    4. We may adjust annual rates. We will inform you if we apply this.

    5. The different types of subscriptions can be found on our website along with details of what is included in each type of maintenance agreement.

    6. A breakdown follow-up is not included under a subscription, we then apply the applicable hourly rate. Materials are charged at the rates applicable at that time.

    7. The subscription has a minimum term of 24 months.

    8. We may terminate the subscription prematurely if the consumer behaves in a manner that is contrary to the generally applicable rules of conduct, if the operation of the installation cannot be guaranteed or if the rules set out in these conditions are violated.

  6. Liability

    1. In the event of an agreement between Intovent and a buyer, Intovent is not liable for any damage suffered or to be suffered by the buyer and/or third parties, unless such damage is due to intent or gross negligence on the part of Intovent.

    2. Intovent's liability - for whatever reason - is limited to the amount paid out under the insurance taken out by Intovent.

    3. If no payment is made under an insurance policy, the liability is limited to the value of the service (excluding VAT) which Intovent has failed to perform, and on the understanding that Intovent is not liable for indirect damage.

    4. Any claim for damages against Intovent shall be time-barred after 12 months, unless a summons has been issued earlier. The statutory period begins on the day following the day on which the buyer became aware of the damage or could reasonably have become aware of it.

    5. Intovent is not liable for the operation/construction of the existing installations and connections.

    6. Limitation or exclusion clauses that can be invoked by third parties against Intovent can also be invoked by Intovent against the buyer to the same extent.

    7. It can always happen that something does not go quite as planned. We recommend that you report any complaints to us first by e-mailing info@intovent.nl. Does this not lead to a solution? Then it is possible to submit your dispute for mediation through Stichting WebwinkelKeur at https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil. Since February 15th 2016, EU consumers are also able to register complaints via the European Commission's ODR platform. This ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not already being processed elsewhere, you are free to submit your complaint via the European Union platform.
  7. General

    1. All images and technical specifications mentioned on the Intovent site are indicative only and cannot be a reason for compensation and/or dissolution of the agreement.

    2. All goods supplied shall remain the property of Intovent until payment in full of all invoices due.

    3. Intovent is entitled to transfer all its rights under the agreement to third parties or to have another party take its place.

    4. Complaints may be submitted to Intovent in writing by e-mail. Intovent will handle the complaint(s) as soon as possible.

    5. In the case of events not described in these terms and conditions, Intovent will decide how to deal with them.

  8. Payment

    By deposit or transfer to a bank account specified by Intovent. Payment can be made by e-payment (Mollie or Paypal) or by depositing or transferring the appropriate amount to a bank account specified by Intovent.

  9. Shipping

    Unless otherwise stated, prices on the website are exclusive of delivery charges.

  10. Privacy-policy

    Intovent B.V. complies with the Personal Data Protection Act and will not provide your details to third parties. The complete privacy statement can be found here.
  11. Applicable law

    All agreements to which these general terms and conditions apply in whole or in part shall be governed by the laws of the Netherlands.

  12. Final provision

    By placing an order you agree to our terms and conditions.
